Why should I use you as an attorney?

What should I know about associated laws?

The different legal disciplines sometimes over lap. Keep in mind that if you have a work related injury (Workman’s Compensation case), you may also have a separate Personal Injury or Product Liability case. Or, if you have a Personal Injury case, you may also have a separate Workman’s Compensation claim. Therefore, it is best that you consult with a skilled attorney that handles both Personal Injury and Work Related Injuries (like Mr. Eckerman), to make sure that all avenues of recovery are aggressively pursued so that you can make the highest recovery possible.


What are my rights?

You have a right to fair compensation for injuries sustained by you due to someone’s negligence. This includes (but is not necessarily limited to) separate items of damages for pain and suffering (past and future), loss of normal life (past and future), medical bills (past and future), disfigurement, and lost wages (past and future). On Wrongful Death cases (under the Wrongful Death Act, and Survival Act), the family can recover most of these same damages, along with money damages for lost love, affection and association due to the loss of their loved one.

You have a right to a Jury trial (where 12 people selected from the community decide your case) or a bench trial (where the Judge decides your case). As a general rule, it is better to have a Jury trial, in that a Jury is more likely to award a higher amount in money damages than a Judge. Protecting and preserving your right to have a Jury trial, is therefore, very important. Your attorney will advise you as to what he/she thinks is the best trial format for your particular case situation.

You have a right to the attorney of your choice. To properly protect your rights (including those indicated above), it is important that you make a wise choice in selecting an attorney. If you make a choice, and later feel you’ve selected an attorney that (in your opinion) is not properly representing you or your best interests, remember you can always change attorneys – because you have the absolute right to the attorney of your choice.


What should I do if I'm injured in an Accident?:

  1. Call an attorney for advise ASAP on how to best proceed under your particular circumstances.

  2. Document everything,
  • Have a police report made out (or an incident report, where appropriate). Remember, be careful of what you tell the police or others who make out these reports, they will quote you as to how the incident occurred in the narrative section of that report. Remember, it’s always best to just tell the truth, or say nothing at all.

  • Obtain and write down the names, addresses and phone numbers of any witnesses, if you are in any condition to do so.

  • Seek immediate medical care if you’ve been injured. Remember that your medical care providers (including paramedics at the scene) will also ask you how the accident happened; and they will put your answer(s) in their records, so be consistent here with what you tell the police, paramedics, and doctors.
  • Take photos of the instrumentalities involved: e.g., of the autos (at least your car) if an auto accident, or of the icy sidewalk if a slip and fall, etc., etc., and photos of your injuries if they will show up in a photo.

  • Get follow-up care, if you continue to suffer from injuries. If you don’t need further follow-up medical care, that’s fine. But if you do need further care, then get that care ASAP, otherwise, if you wait too long to do so, the insurance carriers start questioning whether or not the injuries you are complaining of are related to the incident, or to something else.
